Terms of Service

These Terms of Service ("Terms") govern your use of solbeamrl.com and your purchase of products from Solbeam Co. ("Solbeam," "we," "us," or "our"). By using our site or placing an order, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the site.

Eligibility

You must be at least 18 years old, or the age of majority where you live, to place an order. By placing an order, you confirm that the information you provide is accurate and that you are authorized to use the payment method you submit. We currently sell and ship only to addresses in the United States.

Orders and pricing

All prices are listed in US dollars. Applicable sales tax is calculated at checkout based on your shipping address.
Your order is an offer to buy. We accept it when we ship it. We may decline or cancel an order, for example if a product is unavailable, if there is an error in pricing or product information, or if we suspect fraud. If we cancel an order after you have been charged, we will refund you in full.
We work to keep product descriptions, images, and prices accurate. If we find an error, we will correct it and give you the option to continue with the corrected order or cancel.
Promotions and discount codes are subject to their stated terms, cannot be combined unless stated, and have no cash value.
We may limit quantities for retail orders. Volume orders for clinics and spas are handled through our Clinic & Spa Program, which has its own pricing and account terms.

Payment

We accept major credit and debit cards and other payment methods shown at checkout. Payments are handled by a third-party payment processor, and we never store full card numbers. Your payment method is charged when you place your order. Approved Clinic & Spa Program accounts may be invoiced on Net-30 terms as set out in their account agreement.

Shipping, title, and risk of loss

Orders ship from our Missouri warehouse. Shipping rates and delivery estimates are described on our Shipping & Returns page. Delivery dates are estimates, not guarantees. Title to products and risk of loss pass to you when the carrier delivers your order to the shipping address you provided. If a package is lost or damaged in transit, contact us and we will help resolve it.

Returns

Retail purchases are covered by our 30-day money-back guarantee, which runs from the date of delivery. The full return process, including how bundles are handled, is described on our Shipping & Returns page and is part of these Terms.

Warranty

Solbeam devices carry a 2-year limited warranty, and soft goods and accessories carry a 1-year limited warranty, both from the date of delivery. Coverage, exclusions, and the claim process are described on our Warranty page and are part of these Terms. Except for that limited warranty and to the extent permitted by law, products are provided "as is," and we disclaim all other warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

Product use and safety

You agree to use Solbeam products only as described in the user guide and product packaging. In particular:

Wear the included protective eyewear during sessions with panels, and do not look directly into the LEDs.
Follow the recommended session times and distances in the user guide.
Keep devices away from water and do not use them while bathing or showering.
Keep devices out of reach of children and pets, and do not let children use them without adult supervision.
If you are pregnant, photosensitive, or have questions about whether Solbeam is right for you, consult a healthcare professional before use.
Stop using the device if your skin becomes uncomfortably warm or you notice any unusual reaction, and contact our support team.

Products sold to clinics and spas are intended for use by trained staff following the same guidance.

Wellness disclaimer

Solbeam products are wellness devices designed to support muscle recovery and promote relaxation. Individual experiences vary. Information on our website, in our emails, and on our social channels is provided for general educational purposes and is not a substitute for advice from a qualified healthcare professional. This product is not intended to diagnose, treat, cure, or prevent any disease.

Intellectual property

The Solbeam name, logo, product designs, website content, photography, and text are owned by or licensed to Solbeam and are protected by trademark, copyright, and other laws. You may view and print pages from our site for personal, non-commercial use. You may not copy, modify, distribute, or use our content or trademarks for any other purpose without our written permission.

Acceptable use of our site

You agree not to misuse our site, including by attempting to gain unauthorized access, interfering with its operation, scraping content at scale, or submitting false or misleading information. Reviews and other content you submit must be honest, lawful, and your own, and you grant us a non-exclusive, royalty-free license to display them in connection with our products.

Limitation of liability

To the fullest extent permitted by law, Solbeam and its owners, employees, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data, arising from your use of our site or products. Our total liability for any claim relating to a product or these Terms will not exceed the amount you paid for the product involved. Some states do not allow certain limitations of liability, so some of these limits may not apply to you. Nothing in these Terms limits any liability that cannot be limited under applicable law.

Indemnification

You agree to indemnify and hold Solbeam harmless from claims arising from your misuse of our products or site or your violation of these Terms, to the extent permitted by law.

Governing law and disputes

These Terms are governed by the laws of the State of Missouri, without regard to its conflict-of-law rules. Any dispute arising from these Terms or your purchase will be resolved exclusively in the state or federal courts located in Jackson County, Missouri, and you and Solbeam consent to the jurisdiction of those courts. Before filing a claim, we ask that you contact us so we can try to resolve the issue informally; most concerns can be settled with a phone call or email.

Changes to these Terms

We may update these Terms from time to time. Changes take effect when posted on this page with a new effective date. The Terms in effect when you place an order apply to that order.

General

If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver of our right to do so later. These Terms, together with the policies referenced in them, are the entire agreement between you and Solbeam regarding your use of our site and purchases.
